2. Description of Service

BookTun.ing is a service that creates personalized music playlists based on books. The Service allows users to:

  • Create an account to save and manage playlists
  • Generate AI-powered playlists matched to book moods, genres, and themes
  • Share playlists publicly or keep them private
  • Access playlists through Spotify integration

The Service utilizes Spotify's API to generate and save playlists to our dedicated BookTun.ing Spotify service account, which are then shared with users via direct links.

3. Spotify Integration

Our Service integrates with Spotify through our dedicated BookTun.ing service account. This means:

  • You do not need to connect your own Spotify account
  • All playlists are created in our BookTun.ing Spotify service account
  • You can access these playlists via direct links we provide

You acknowledge that your use of Spotify playlists created through our Service is subject to Spotify's Terms of Service and Privacy Policy.

4. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Immediately notify us of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

You may not:

  • Use another user's account without permission
  • Create an account using false or misleading information
  • Create multiple accounts to circumvent restrictions
  • Transfer or sell your account to another person

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Conduct and Content

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe the rights of any third party, including copyright, trademark, or privacy rights
  • Post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

User-Generated Content: You retain ownership of playlists you create. By making a playlist public, you grant us a non-exclusive, worldwide, royalty-free license to display and share that playlist as part of the Service. You represent that you have all necessary rights to the content you post.

6. Intellectual Property

All content included on the Service, such as text, graphics, logos, software, and the Service itself, is the property of BookTun.ing or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

Music tracks, album art, and Spotify-related content are the property of their respective owners and are used in accordance with Spotify's Terms of Service.

7. Account Termination

You may delete your account at any time through your account settings or by contacting us. We may suspend or terminate your account if:

  • You violate these Terms of Service
  • Your account is inactive for an extended period
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to use the Service will immediately cease. We may retain certain information as required by law or for legitimate business purposes.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BOOKTUN.ING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damages arising from your use or inability to use the Service
  • Unauthorized access to or alteration of your data
  • Any third-party content or conduct on the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless BookTun.ing and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you post or share through the Service

11. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BookTun.ing operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookTun.ing regarding the Service and supersede all prior agreements and understandings.
